Topic - How to Avoid Becoming the Next Cyber “War Story” - This panel will focus on tangible tips to help carriers and insureds from becoming another cyber “war story” of disastrous exposure and liability.  We will discuss several high-profile cyber debacles, both pre-breach and post-breach, and then offer tangible tips to help prevent those from happening to carriers and insureds.  Pre-breach “war stories” include poorly constructed and deficiently managed risk-reduction programs, including weak risk assessments and table-top exercises, which have created powerful evidence for plaintiffs and regulators.  Post-breach disasters include incompetent breach responses that have resulted in the disclosure of forensics reports in litigation; ill-advised coverage decisions by carriers that make bad law; and even a criminal conviction of Uber’s Chief Security Officer who insanely tried to hide a breach and bribe the hackers.  While carriers and insureds probably wouldn’t try that at home, or in the office, there are many lessons learned from these disasters, and we will offer specific steps to absorb those lessons and avoid costly and potentially debilitating mistakes.
